If you decide to refinance and give them the money, you'll have to get an attorney or escrow company involved to transfer title.

In either case there most likely would be a public record showing the transaction and parties involved. 

The only thing I would want to be involved in are the finishes.

There have been quite a few mortgage related frauds that have caused the legislation to get involved... and for good reason.
