Putting real estate assets into an LLC or trust are all terms I hear about but am wondering if that would be appropriate and/or necessary in this situation to off set any potential liability?

The general interpretation of simultaneous for purposes of the 1031 is that both sale and purchase are under contract and close within a day or two of each other with the funds being sent directly from the sale to the purchase escrow.

In such cases, you would lose your tax exemption.To avoid risks, we coordinate the purchase of the replacement property with the sale of the relinquished property.

I'm wondering if there are any real estate attorneys who could assist on what steps we should take to get this process finished so we can move on, ideally we would like to have a new registered agent as this attorney cannot be relied upon.

I'm trying to self manage and was wondering if you all used a property management software to manage the  STR and MTR properties or if you use 2 separate softwares if any?

Someone made a comment as to the appraiser not knowing the sale price.

If it were me, I'd tell my brother than I get my downpayment back first, then we split and additional profit at sale 50/50 (presuming he matches your other expenses).
