I would certainly include this in the lease and if they fail to take care of it, you get someone to take care of it but bill it back to the resident.In a judge's eyes it's easy to see the residents failure to follow the lease as long as you are upfront about it upon move in.

If they clarify and explain a legitimate concern, I would have someone fix the issue before failure.
