The hurdle I'm running into is whether this can be a personal checking account, or needs to be a business checking account.All 3-4 people I've talked to said to simply form an LLC, and transfer the title, without a solution to renegotiating my mortgage in the process.

I’d love to be able to either cash out refi, lower the interest rate, keep the payments the same OR simply refi the loans at current values, lower interest rate, and juice the cash flow a bit.

That is the whole idea of self-directed investing- that you are able to make choices that are not available with typical IRAs and 401ks, but it is up to you to make good choices based on your situation and goals.As for fraud, I believe most of this has to do with the investments that can be made with a self-directed account that are simply not possible with a typically-restrictive IRA or 401k.
