I would think that by not splitting the profits to some degree would put me at issue legally (i.e. it would be a tax avoidance scheme) b/c by being the credit partner I would obviously be a partner in the deal.

Because the Land Trust is an Inter Vivos Trust (estate planning tool) and excluded from the Due on Sale Clause thanks to the St Germain Act, these transfers do not trigger the same red flags for lenders.
