If the owners fail to maintain a formal legal separation between their business and their personal financial affairs, a court could find that the corporation or LLC is really just a sham (the owners' alter ego) and that the owners are personally operating the business as if the corporation or LLC didn't exist.

There is nothing wrong with you inquiring and asking for the listing if it's not on the MLS as you need to know about 1. your agency relationship and 2. co-brokerage arrangements before you make an offer.If he just has a pocket listing, he can probably formalize that at any time, even if he were shady, his relationship will probably survive.
