This was apparently accomplished.So far as I know;  no documentation has exchanged hands.My plan is to replace the rear sliding glass door with a 36" exterior door and a double-hung window to fill in the large opening.

The whole concept of a contract is not the legal terms and out foxing someone, but it serves to document the agreement, clearly and in precise terms so that anyone can understand who said and agreed to what.

If your intent when you bought it was to hold for productive use then it is qualified property and you can 1031 it.You'll want to make sure that you have your documentation and demonstration of intent ready if audited.
