I have tried to file in Small claims court but the SOONEST court date they can give me is MAY 2016, and I feel they will not take this court date so far away seriously and I new to recover some funds so I can complete this project and move on.

@Mark Shafer, I would say also look at how long the town homes in that complex are sitting in the market before they sell and at what price: that gives you an idea of how quickly you can sell it if you needed to and at what prices.

It was undoubtedly the appraisal That is the highest amount difference($100,000) I ever heard between selling price and appraisal The agent who sold you the house, seller, can all be culpable but do to the small amount($2000) try small claims court I would file a complaint with the real estate board also .
