Somebody I loan money to has signed a promissory note, but not an authorization to check her credit. As her lender, is it legal for me to pull out her credit report now without her authorization ? Both of us live...

I believe while this seems to be an issue in some areas a better way in all areas would be to use a Warranty Deed or if the is financing involved, a Special Warranty Deed subject to the existing financing.

So your $6k out of pocket gets you a C Corp and ability to use retirement funds to buy stock in your C Corp.The things I did not consider:- You are an employee of your C Corp, so if you hire any employees you need to extend many of the same benefits to them that you receive, including participation in retirement plan- If you hire employees you need to offer them the option to also use their existing retirement funds to purchase equity in your business- Possible advantage of LLC over the C Corp- Once you sign and speak with your assigned independent counsel they will advise you on the increased scrutiny you face with IRS, need to keep additional records and document corporate meetings, etc.If I had a more complete understanding in advance I may not have gone this route.

If you have an existing LLC the loan is made to the LLC without putting them on title as that puts them in a purchase of your business interest and any lien on the property makes it a mortgage, IMO you want to stay away from both.I have suggested in the past that LLCs be set up initially to allow a special category of members who do not have management or voting rights.
