It sounds as though J Scott obtained one as well but it doesn't guarantee repayment if they declare no assets.Is declaration actually investigated or just word of mouth taken as testimoy since it is applicable to a court proceeding?

Have him make you a loan which you could use as down payment on a property or for repairs.You can offer to pay him interest on this loan which you would re-pay when you sell the house or re-finance it.
