A simple joint venture does not require an LLC, it just needs an agreement.An LLC is a legal entity which can provide (not guarantee) additional liability protection.Cons are that financing is harder to get and all activities will be shared with members of the LLC or per the operating agreement.

Who told you that title didn't pass to the surviving spouse, joint tenancy usually does and there is no probate involved in title passing. :)
