Assuming it does apply and the loan is not compliant, that does not mean that the borrowers can never be foreclosed upon, however, the borrowers may raise defenses and/or counter-claims for a set-off and/or recoupment which may cause your deal to be cost prohibitive.

Unless you own where nobody wants to live, or have units with dysfunctional layouts, I'd say the best defense against vacancy is a fair price for a nice unit, add on some respectable management for good measure.
