Another option I have seen implemented at one of the properties we purchased that is metered separately is allowing a certain amount for utilities each month and if the bill for that unit goes over the specified amount they would be charged for the overage.

Smart HOAs will raise fees by a small percentage yearly rather than not increasing fees and having to implement a special assessment down the road but many boards don't look that far ahead.

I am assuming they closed it all off to prevent pests from coming in, but what they actually did is contain the moisture build up.

Typically, if you can see the listing on a public facing site like Realtor.com, it's still an active listing however old.Also, most listing agreements include a protection period (typically 1-3 months) after the listing expires that prevent the seller from making a side deal and waiting out the listing agreement.Why do you not want to go through the listing agent?

Since they took no action to correct the problem and stated, "this is a common issue in the whole apartment", I would believe the Judge would call it "normal wear and tear".I would think an easy and affordable fix would be for the landlord to install shower doors to protect their investment and prevent further damage.
