The city/county says well if you want to improve the property you have to bring it in to compliance. that could mean modifying the structure to not be in the setback or buying a strip of land from the neighbor.

Thanks for all the responses, definitely some things to consider that I hadn't previously, and assurance that I can at least make some headway on my own.
