I ask because im really trying to speed up my investing process with cash flow and hustle to do so by putting a second Duplex (there will be 2 built at same time) in my girlfriends name and ill fund it and then transfer ownership after the 1 year requirements are up, but so i don't have a empty unit (One she's "living in") I would airbnb it so theres no leases where i could legally get into trouble.

@Jeremy Martin the Sec 121 exemption you're referring to actually requires that you meet two tests: the use test and the ownership test.

Set up Zillow alerts for all small multifamily that "sell" (when properties transfer ownership landlords will be more open to talking) Network with small multifamily relators about buildings that are under renovations and will have multiple units coming up that need to be filled (problem) where you can "pre-lease" the unit and pay the landlord the 1st day it's available (solution) Remember the name of the game is "How do I profitably solve problems for the people I want to work with!"

@Stephen WalleyAnswer is It Depends on what the PPM and operating docs say.Some operators take the LP investors out of the deal once all capital is returned.Other operators keep the LPs in at the original ownership percentage.($1M raise $100,000 investment on a 70/30 deal, that LP owns 10% of the LP part or 7% of the deal.
