Magistrate and State Courts have no jurisdiction to hear a dispute over equity in Georgia, and the suit would have to be done as a suit in partition/ejectment in Superior Court, and you're looking at 12 months of litigation, rather than a couple of weeks.

If it doesn't say, then it is ultimately a court who sorts it out if there's a conflict, but I wouldn't expect most courts to side with a landlord who just decides they want to use the backyard themselves for bonfires or storing their junk.
