My gut was telling me similar things, and I've been trying to balance the impacts of UGB vs. the new tenant laws...so your points are well taken.  

You have to make sure you don't get on the wrong side of the law by advertising but if you have existing relationships you can leverage those.

It looks like Berkeley has some new rules about it but does anyone know how strict they are that it "Must be your primary residence?" 

They sell the majority of their loans to Fannie/Freddie so they need to adhere to very strict lending guidelines.
