Neither one of you is a judge...and don't know what a judge would decide...so to me it is your position that it is criminal and a judge can decide that later, you just need them out of the house.

For example, if you need hard money to get a property that's going to either cash flow or flip for big dollars but it's going to cost 4 points to use that guy's money, it's up to you to decide if it's worth it or not.

I don't know how quickly yours get tenants, but if it's not rented in 2 months you can decide if you want to pursue the legal action or not for the remaining month.
