If your client overlooked that then he is at fault, but could prevail if sec dep statement was not sent out with explanation in give state time period.If the landlord failed to give him a security deposit statement (why sec dep was withheld) within 30 days or 60 days per lease, in the mail, written, then landlord is in default and he could prevail in court.It really doesn't matter that the client didn't actually live in the apartment, during his waiting period, he still had rented it and landlord couldn't re-rent until notice was given.Like you said your client took a gamble it's unfortunate, he's lucky to have a advocate like you.
