I've tried looking up the potential liability of a Salesperson in the line of doing normal work.There are a number of tricky things, especially here in NYC.Just to give a clear example, let's say your client is a Buyer and you are showing him a Property built in 1960.According to the the EPA, the Buyer should be presented with a Lead Paint Disclosure when purchasing any property built prior to 1978.If a Buyer never receives this disclosure, buys the property, then later discovers there was Lead Paint, then sues.... who can he sue?

Basically If I get a short term loan in order to pay for a property and then a year later go to the bank to get the refinance to pay back the loan... what if the market declines or for some other reason I can no longer get a refinance to cover the loan.Is that just when I throw my hands up and say "well, time to file for bankruptcy" or are there other options?

The one thought I believe is missing is that while most hard money lenders and private lenders prefer short term loans, there is a minority that actually prefers longer term loans of about 2 years or more.
