More people let it go than not in my experience but there are always people that love to litigate! 

Tenants typically do not have the money to engage in litigation to get the money back, so this becomes a straight money power play.If we can find any equitable way around landlord abuses when it comes to this issue, the whole industry, especially us little guys, will be in better shape.
