If this house needed some work or was bank owed, it would sell below what the market value was at that point in time, which would make it appear to appreciate more, purely looking at the sales price, but you have to account for any capital expenses which were invested in the property.

But even then you would have to keep receipts and have specific language in your lease about how often you pump the system and what is considered "too fast", even then you might have a hard time proving that in court unless they fill the system in 6 months or something crazy like that.
