I have treated the downstairs tenants nicely and given gift cards and told them if they could hang in tIL the court evict the upstairs tenant's which takes time and is a process which sucks but I have to follow as a landlord so today I recieved a call from downstairs that the upstairs tenants dog is still pissing off their deck onto the downstairs tenants deck and on some of their belongings the police were called and can't do anything but seemed mad at me like I'm not doing anything about it.

Initially I thought one of her kids left the sink on and stopper closed, now I'm thinking that this is the first time they ****ed up their sabotage and had the water flood the neighbors below rather than skyrocket my water bill (so she was mad about the fact that her family spoiled her sabotage rather than at the fact that they damaged the property). 2nd floor tenant also mentioned that she heard the water running daily when the 3rd floor tenants would leave the house but didn't think much of it (I wish she told me this earlier).- I've analyzed a few options, sub-metering is a no-go because Massachusetts laws are flawed and don't allow it until a new tenant moves in, by which time I'll probably be bankrupt (because eviction can take up to 2 years and is very tenant-friendly, at the same time this tenant can keep wasting $2k+ worth of water every month).

I use bird dogs from time to time and I never get mad at them for calling other investors on a deal as long as they call me first :).

This is why with apartments I do not get landlord agreements with the power companies.The tenants will call the power company and lie and say they are moving to another address.The power company then transfers to you the landlord and a few months later you get a huge bill.I would just pay the 30.00 turn on fee if I needed to work in the unit to get ready for re-rental.Much better that way and the tenant can't run their scam that way.I did catch another tenant of mine (section 8)plugging into a vacant unit next door on the outside plug.I had power turned on as I was working on that unit.I unplugged the first time and they kept doing it so I took a picture with time and date and called the cops.Made an incident report but not a formal charge.Police politely told the tenant you can't do that ( I wasn't there when he explained to them) and that if it happened again they would have some new arm bracelets to wear.They didn't do it after that.The cop said I could have filed charges instead of incidence report but that he thought a warning was best versus arresting them and then they get mad and do damage to the unit.He said if it happened again maybe go the other route.I kept the documentation and pictures to show the character of this tenant in case they tried to make any claims or lawsuits down the road etc.I have had my fill of low income tenants.Too much drama there.It's not usually worth the extra few percent annually when you account for everything.

I fear that if I give notice to my current tenant he'll have extra time to be mad and become a major headache for me.
