If she knows that the house is being shown and doesn't do anything about it then she could risk violating her subscriber agreement, getting hit with a big fine, and/or loosing access all together.That said, she could have sketchy motives and just be trying to "get a higher commission" - but its very likely that her motives are aligned with the sellers in terms of getting the best deal possible.

My advice to the buyers was to either require a clear title or walk away - unless they wanted to live with the fact that one of the inheritors could come back in the future and make a claim against their property - and as real estate values continue to climb, that scenario becomes more and more likely.All it takes is for one of the inheritors to get a sniff of money in the air and all hell's going to break loose.

If the lender however, requires you to live in the unit to obtain financing then you are not bound by any agreement because you are covered by the "could not obtain financing clause" due to there not being a vacant unit.
