same as buying a 1st position mortgage at foreclosure.. your correct every county has different bidding procedures as well.. bid for assets has taken over many of the tax deed sales . so its done on line in many counties in CA nowbuying a tax cert like in AZ is just the first step in a long journey to actually gain title to the property. and i do believe that if you quiet title the mortgage lenders and other liens will be wiped out as well.

The foreclosure procedure appears to have been made some time ago, under federal law, any borrower must be given notice, regardless as to what may have been agreed, IMO.If you have a NPN first, simply include the balance of the second, if you hold the second, better cross your fingers and pray, but I can't see you holding a housing development note either.Call the development office, they should tell you how they view the lien and your position, it's best to clear the air than to speculate, but I wouldn't have an issue with that mortgage.

So for her the 1031 is a very doable procedure to defer the tax on that $500K gain (plus probably a bunch of depreciation recapture).
