Once escrow is opened, both buyer and seller have to authorize any changes in escrow instructions.Typical seller paid items:Deed preparation; existing mortgage and accrued interest; transfer taxes; commission; title insurance; repairs based on termite inspection report.Typical buyer paid items:Hazard insurance; document preparation fees; survey; mortgagee's title insurance; credit report; loan origination fee; prepaid mortgage interest; discount points; Recording fees (deed and mortgage); termite inspection.

We have already found a builder who will build the homes for $140K give or take and all the surveys have been completed.

Meanwhile, study the listings in your area intently, check out what is popping up on Craigs List, look for real estate companies with web sites and study how they pitch their properties, go visit some apartment properties, drive around and survey your area, etc. etc.I also like having partners.

But there is pretty much no way to get my appraisal and survey money back.If the stars line up, I may still be able to acquire the property - but after the 3 ring circus this lender caused, I'm sure the seller/agents are all going to avoid me like the plague.

You can always get a copy of the title binder at closing and have the title company "mark it up" (initial the elimination of exceptions that will be taken care of out of the closing - ie. satisfying liens, taxes, survey exception, mechanic's liens, etc.)
