I am an agent and while you are partially correct - the majority of life insurance policies are structured for leaving the death benefit to the insured's beneficiaries.However, when a client asks for an 'infinite banking' policy, they are asking for a vehicle to accumulate cash that has tax advantages, moderate growth, liquidity and no exposure to market volatility.

I realize alot of investors have absolutely no asset protection ie LLCs for their properties and have been told by a couple of attorneys that im over thinking and perhaps paranoid of being sued, california as well as the entire US is known for excessive litigation.

The title company replied that when a contract is cancelled, they do not assume anything for the same reason. what they need is a signed agreement between seller and buyer telling them who gets the EMD. if there is no agreement, they will continue to hold funds until there is a mutual signed agreement.

SFR with ADU is no problem. but if you're considering adding an ADU to a multifamily property, consider the limitations you're creating on your back-end buyer if you decide to sell, or your own financing if you choose to refi.
