For now I do not have $25K to give them, so I have one rental home for sale and plan to make them a smaller offer if and when it sells, and take the rest to pay down one of my mortgages against my own home and use the rest to do one low cost rehab flip without having to go to a lender, sell and repeat until I can pay down that entire 2nd mortgage on my own home, and this should strengthen my position and stabilize things a little better.  

Alternatively, when a 1031 is not an issue you think about it as receiving your basis first in your gain only after and so I believe that's what David was saying at the bottom of his post but I just wanted to strengthen it up a little bit.  

With the continued growth here, we should continue to see a strengthening rental market.  

If you have documentation of the replacement value of the building (such as from an appraisal, your insurance company, or construction records), that would strengthen your case in the event of an audit.  

You will gain good experience and strengthen a key relationship at the same time.

When I worked for a big PM firm here in Hawaii, we did accept partial payments, but of course we had them sign off on a payment plan, and supposedly this paperwork would strengthen your case if you ever had to go to court to evict. 

I would also strengthen my argument even more for cash flow now if there are A&B shares in the deal and the lower 15% sat first in line on the capital stack with the "A" share capped at 25-35% of total cap stack.

I think it's something you can handle, but you'd strengthen your decision-making and potentially overall project success by bringing in someone with more experience. 

To strengthen the offer we stated that any shortage of appraisal up to $5k would be reduced from both purchase price and closing credit, keeping the seller at $195k.
