Lease to own makes sense: higher down payment deposit non refundable, tenant is responsible for fixings, tenant takes better care of place, tenant only exercises half the time, you can raise monthly payments a little higher...Id like to use this strategy going forward....but I never heard that eviction is completely different, between weeks and years.Would you share a contractual way to avoid this lengthy and costly eviction, and further experience.

Hi @Joseph ODonovan - as long as your reason for declining does not violate FHA as a protected class, then yes (but please proceed with caution; as Catherine has carefully noted above you have to be super careful that they do or do not meet clearly outlined qualifications that you've set for your rental - and if what others have said is true about income being added as a protected class in Philly, then you have to keep it open to those with Sec. 8 vouchers; the sec. 8 process is lengthy too).

Upon looking further into the scenario, the necessity of payroll, quarterly reporting, and the more expensive and lengthy (1120) return with the S corp is enough to turn me toward just being taxed as a partnership and keeping it simple for now, especially since the business has very little income.
