The federal courts have the power to fashion "common law rules" in areas where federal and state rights conflict and there is no clear statutory authority that governs.

I've gotten conflicting answers thus far.

Certainly their ability to pay is an important factor but so is: their track record of treating the property with respect, being drama free and getting along with the neighbors (or at least not causing conflict with the neighbors).

It just creates too much conflict of interest. 

It must have been so conflicting your family passing and at the same time that meant you were stuck with this problem property you didn't necessarily want...

So, they have a conflict of interest in waiting for the right tenant.
