Hello, I'm under contract on our first house and was wondering ...I understand that it is Mortgage fraud to rent out a property you just purchased with and FHA loan without living in it for 1 year..

Even if you still live there at the moment, your INTENT clearly is to use this as a rental, so be careful about not running into mortgage fraud traps. 

I was released for the remainder of the balance sue to a short sale value so it actually never hit my credit,  fast worked to now almost 10 years later.I am in the market to buy a home again, my credit is fine and has been but one of the banks I am seeking to get approved with told my I came up on a fraud check as having a foreclosure on my report, whatever report that is idk, they were perplexed as well since it wants on my credit.  

I sent out an almost identical letter to what he described.  

Not surprising as there are also fake pay stub companies out there (they really should be stopped as they're helping commit fraud).Personally, I don't call former landlords.

Can you buy a property, showing intent to live in it, leaving the unit vacant not committing fraud?

Obtaining a loan under false pretenses is fraud. 

Practically identical process...more of a suspenders to her belt approach tho.
