If it quacks like a duck it probably is one.Sounds like the ex tenant is guilty of fraud, and it should be pretty easy to prove when the banks investigate.

It isn't my style to walk into someone's business and treat them as if they are guilty before proven innocent...and I couldn't understand why someone would respond in that manner based on my line of questioning.

They may not be guilty, but they are looked at. 

I did as much research as I could on Google in a 15-minute period to see what actually happens if you are guilty of offering securities without a license, and you did not commit fraud.  

I hope they aren't considering EM as consideration.And while I am not an attorney I am not sure how a C&D can prevent someone from applying for and obtaining a license/certification, I would think that there would be an issue with the presumption of guilt without having been formally investigated, charged and found in violation or guilty.
