I'm not sure why this transpired as it did  (distribution of information in a timely fashion to all parties involved), but if you truly desire not to sell, it sounds like you could be able to exit the deal after all and proceed moving forward in another direction.

I have found private equity and have been asked to submit a proposal as the party with the equity has not loaned money in this fashion before.

While we are for sure in a texting day and age, and she may indeed think the money she's giving him is going towards rent being paid in a timely fashion, it seems like it could cause more issues than resolving them.

My thought is that the statue was not created for a situation like mine where an incompetent title agent didn't record the deed in a timely fashion. 

This first month has been spent just learning, going on ride alongs and checking up on deals, appointments, and showing homes.

The business pays lots of bills like gas, tires, oil changes, eating out with clients, steak dinner for twice monthly board meetings with my wife/partner, trips to see properties where I happen to have a bike ride and stay the weekend to look at properties(air bnb stay is a business expense as well as food).
