If she was ever served with a notice of foreclosure, even if the lender did not follow through with the sale, she can't do anything with the property except sell it and payoff the lien.The law allowing for the forgiveness of debt to avoid taxation is about to expire so now that she has waited she may have a tax liability on amounts written off from her underwater property.A short sale would be best, if she qualifies, but to do a short sale the owner must have a financial inability to pay, I'm not sure the bank has to agree if she is sitting on cash.IMO, she needs to pay as agreed, catch up the loan, then lease it over time allowing the value to come back and then sell it. :)

However, when I sent the contract over to my lender, he informed me that there were some changes coming from Fannie in 2014 that will make it more difficult to go with a conventional loan with 5% down on an owner occupant duplex.So my question for the BP community is, what do you know about the changes coming in 2014 and what effects will it have on a young investor like me who wants to start with an owner occupied duplex?

When I walked through the house to look at it the dogs definitely used the bathroom in the garage and chewed up 75% of the trim throughout the house and my dogs while inside by themselves they ate through the drywall in a few places in the house and this is where my biggest concern is that mold from the dogs urinating on the walls and the moisture seeping in and not being noticed and mold growing from there.

As @Joe Gore mentioned, you won't be able to do this with any bank that underwrites loans for fannie or freddie, which is *most* banks that offer a 30 year note.One way around this is using commercial loans which will allow you to set up an LLC with an operating agreement that stipulates all of the details of the arrangement.

A private investigator or skip tracer might help but actually I'm not sure throwing more money out to find him would payoff as the authorities will be looking for him popping up.If it were me, I'd post the guy's name and company name stating the facts, it would certainly give notice to others and he's in no position to do anything if you state the true facts.
