The second got wiped BUT filed a lawsuit claiming they did not know the power of attorney signed the subordination agreement and since the loan was dated after theirs they feel they are in first (even though in this jurisdiction a subordination agreement is not needed and the refinance of the first is automatically subordinated).

Good luck.yea if folks are savvy enough we can generate safe 30-80% annualized return from hedged position at TSLY/CONY LOLThat makes even preferred equity in CRE real estate(that's typically 13-15% with much higher risk of being wiped out) or CEF 5-8% like thing in the past.
