Sounds like the seller is trying to give a cap rate of somewhere around 10% (just doing the math in my head).

As well, if you didn't live in California, and tried to 1031 it to your state of residence, say Oregon, you could be hit with a cap gain holding requirement from California resulting in no tax deferment.

If that's the case, the property would be considered an owner occupied property and not an investment property from a value standpoint which means a CAP rate won't apply in this circumstance.

But that being said, I also was wrestling with the fact that cap rates are in favor of sellers right now, and it might now be as low a cap rate a year from now. sort of worrying about missing out on these crazy low cap rates.... and crazy high equity.
