To clarify a few things.A good faith deposit is very customary in commercial lending.

There are things such as fraudulent inducement, dealing in bad faith etc. that can come back to bite you if you had no intent of no ability to close the deal. 

Was a good faith effort made to keep the property habitable?

See a sample Uniform Residential Loan Application used in Illinois.Within 3 days, the lender sends a “Good Faith Estimate,” or GFE, to the buyer that is a breakdown of estimated closing costs.

(read: "incomplete application")  I think they did not act in good faith by springing this on you at the 11th hour, and my confidence in our business relationship would have waned.

Tenant understands that although the Landlord makes every effort to make the Leased Premises safe and secure, this in no way creates a promise of security.I've never had to go to court over something like this and am not sure it would carry any weight but I figure if I'm making a good faith effort to keep the place secure and I have this in the lease it can't hurt. 

You (or the owner) have a legal obligation to make a "good faith effort" to procure a new tenant.
