While AB-68 is one of the bills that updated ADU law, it was merged with two other bills, and this merger has led to some changes.Currently, the section you referenced reads “One accessory dwelling unit or junior accessory dwelling unit per lot…”.

It basically indicates the ADU is to be approved if there is no Heath and safety issues (2) The owner of an accessory dwelling unit that receives a notice to correct violations or abate nuisances as described in paragraph (1) may, in the form and manner prescribed by the enforcement agency, submit an application to the enforcement agency requesting that enforcement of the violation be delayed for five years on the basis that correcting the violation is not necessary to protect health and safety.(3) The enforcement agency shall grant an application described in paragraph (2) if the enforcement determines that correcting the violation is not necessary to protect health and safety.
