Let the tenant know in no uncertain terms that you are not waiting for funds from the prior landlord (as others have pointed out, it may not be kosher for you to accept funds from the other landlord, and you don't need hassles with the government).

This is not an LLC specific issue, but if you plan to operate in several states, you may want to choose an unusual Name to begin with.Along with a LLC certificate and filing, you will need an Operating Agreement for the LLC.
