@Drayden Morgan In my state (CT), tenants forfeit interest on their security deposit for any months they pay rent 10 days or more late if the lease doesn’t have a late payment penalty that the tenant actually pays.

Generally, unless there is a clause that states you're out of the deal, your EMD can be forfeit.

If they don't do those things or later change their mind, they forfeit the entire holding fee. 

I know there is the selling of the property, refinancing, equitable forfeit (putting your own property on the line in the event the deal falls through). 

If they do not hold up their end of the agreement before that start time, then the Deposit to Hold is forfeited and the lease is not active. 

We had him sign a contract that specifically states he will “forfeit the non refundable option to purchase” if he does not purchase the property.
