And instead of giving it back to her, you told her that you'll take it to the pound, even though you knew that it was hers.Your legal remedy would have been to give a pay or quit notice - you can not just take her property and 'dispose' of it because it's not in the lease.

The typical remedy would be for you to issue a "cure or quit" notice to the tenant, essentially telling him that he has to cure/fix certain lease violations or quit/move out.

Jacob G.I will admit ignorance to rental laws in Ohio, but the need to paint and replace carpets after a 4-yr tenancy would be deemed "normal wear and tear" here.That said, if your lease was very clear that smoking was not permitted, you may be able to make some claim for additional work required to remediate from the smoking {we've had to replace drywall before}.As for the filth, hiring a cleaning service to clean the property and appliances should be a something you can claim.
