Let me also tell all the other posters we are not making a crazy profit, the spread is going to be less than 20% after adjusting the appraisal, and feel that we probably could have gotten the appraisal number up with a formal reappraisal and value dispute but we decided to move forward with the sale rather than waste additional time and consider it a learning expense for making a house too nice.

Your operating agreement should cover things like share amounts, how many and who needs to authorize a sale or purchase of property, how the money will be distributed, how parties resolve disputes etc....

The quickest resolution might be to simply challenge the info as incorrect, providing the court documents as proof the loan was foreclosed on.

We have found that most sellers are selling because they can't control there asset and let the tenants walk all over them and most tenants that don't pay or only pay half can pay if it is made a priority by the new owner.As far as your diagram above it was a little hard to follow, maybe you can have your realtor look it over and discuss it with the listing agent for dispute.

YUP just another dude trying to scare people into asset protection when in fact most folks in the landlording business have plenty of protection with proper insurance... and most of these folks answer I will bet have never been in a deposition or any other real estate dispute and have no idea how easy it is for a decent lawyer to harpoon you in a depo... this stuff simply does not hold up as you stated... if the company is broke the veil Is pierced right there rookie lawyers know this experienced one's will rip you apart..
