@Keith Thompson In Alabama, and @Denise Evans correct me if I am wrong, owning the certificate gives you the right to secure the properties and then some although there are different requirements depending on occupancy and cooperation of the owners/tenants.

I feel like this is a gray area that you may not have to deal with as an investor but I certainly do as an agent.

And yes as @David Thompson said the deal you are being pitched is better than most I have seen. 30% to the sponsor is more common and usually they are charging fees as well.
