If the fifth isn't permitted, and you want to go and make it legal...you may be looking at having to sprinkle the building unless your city has adopted the existing building code.

I could see where on a $100k or so property  $2-3k to replace for flooring might be hard to justify, so if you are bound and determined to keep the carpet try buying 2 big bags of baking soda (warehouse stores --maybe $7 for a 10lb bag), and sprinkle generously over ALL the carpet.
