It could be a nuance if you have a lot of false alarms calls. 

One of the key traits I rely on REI is trust and they lost it with me by not only putting false information on their website and valuation report AND standing by those erroneous reports.

The idea of going to court over a tenant smoking with the cost of court is kind of absurd, so this is more of a way to be firm up front and try to smoke out tenants who plan to flout the rules than it is to set ourselves up for a court date. 

They do false advertising & are just trying to get your money.

Thank you two for the replies.Well the main point of me not purchasing as a primary is because it's a Fannie REO so a bit too shaky to actually risk that.The law is absurd.
