@J Scott  for all those reason you post  I prefer to just be the money and not take any money from the party doing the work. .. but I also take title .. that way there is no big drama no lawyers fee's etc etc.. logic dictates.As you know I had a bad one in Atlanta recently it was a long post here on BP and a couple of other BP members are stuck.. they went into the deal with JV deals giving the guy doing the work far to much power..

Now with a physical lease they may have bought themselves even more time before you can get them out.Not to sound harsh but you have said you bought two nice area properties before and haven't been through hard knocks over and over again with these areas and types of tenants.If you have someone beating down your door to buy this from you where you make a quick 10k in profit you might want to take that and run before it's too late.
