The process for foreclosures under a Deed of Trust (D-T) Power of Sale (PoS) are covered in the NC General Statutes, specifically NCGS Chapter 45 Mortgages and Deeds of TrustFor property  tax sales, which are a little different (about 5 pages different) than the D-T power of sale process, see Chapter 105, specifically 105-374 Foreclosure of tax lien by action in nature of action to foreclose a mortgage.

For example, if you can show the debt was paid off and the lender simply failed to record a release or if you can show a statute of limitations has barred the enforcement of the debt as a lien on the property would be a basis for the suit but simply asking the court for relief because you didn't know the prior mtg was there when you bought the property and you can't sell or borrow against the property probably will not be sufficient to get the court to quiet the title and a good attorney probably wouldn't waste your money filing the suit.

What did the original post say. i would go by whatever was in your original source and use that to try to Google the appropriate statutes and then read what the statute actually says. i would also consider running it by a real estate attorney in the area.
