(I have a special needs trust for my son so have dealt with the complexities.)My bigger concern would not be your liability exposure but doing something that could potentially endanger the support benefits your brother is entitled to.

It's important to know how your lease was written.In Manitoba, domestic violence is a reason for termination of a lease - but I believe only the tenant (victim) may invoke this clause of the act.The tenant still has the duty not to disturb (Section 73) or endanger (Section 74) others in the building.

Failure to do so most assuredly, at the least, open you up to common law liability.PS: I understand your frustration when someone says "go speak to a lawyer", but at the same time you shouldn't be giving legal advice which could actively endanger the other party.

If it appears a person is in the unit and endangering themselves or others, we would call 911 immediately and entry could be made as per the emergency clause of our rental agreement.

I came home to an email that said " if my air conditioner is not fixed by 6 PM I am calling the police on you for endangering our lives" I emailed back and asked if he had recieved the fan i had our handyman dropped off, he said yes.. then I asked if he had opened the windows for air flow.. he said he wouldnt open the windows due to safety issues..
