If your intent was to hold the property for productive use and you can demonstrate that wit past practice, documentation of conversations with your professionals, rental agreements, actual rent, etc then you could indeed do a 1031 because your intent was to hold and something external changed that intent.And the unsolicited offer is the gold standard of something that can change your intent. 

Secret service, witness protection, senator/house of rep, police detective, etc.

I would go to the rental unit and take someone with me (as a witness and for some protection) and address the situation in person.

You were not a witness to the prior lease so someone needs to testify as to foundation for the tenant signing it and his not paying rent.

Like I said depending on how this person took his own life will probably depend on the steps you need to take.Every state and county are probably a little bit different, but I know we have a county office called “Victim Witness”.

I have recently witnessed some people around me that I look up to have financial troubles in fields/jobs that should be “secure.”

To wit: We had to teach a local that we didn't consider it OK to chew on twigs and spit them out while in a motor vehicle that you do not own (chewing on twigs from a particular plant being the local equivalent of brushing one's teeth).

I think this relationship is done....even if he comes up wit the $$ I would want him out....freshen up the house and re-start
