Is there specific verbage I need to include to protect myself in case in comes in lower?

In many case, in almost any publicly traded issues the quoted price will be at or within a fraction of a percent of the market price.Actually, valuing the IRA notes using unpaid balance is the equivalent of a conventional custodian using the par value the stock was originally issued at as reference for the value.  

That's not the case in this scenario.   

Agree with @Alyssa Dyer’s points on speaking for the whole of the local investors being SFH off market here, but this of course is likely the case in many places.

@Michael Swan I have found this to be the case in our area as well.

Maybe if you own the land as well it could be okay, but I don't believe that is the case in many areas.  

If they do not move out by the deadline on the demand, then I file an eviction case or “dispossessory” case in the local Magistrate court.

While "loan purpose" can make a loan against a homestead the proceeds of which are used for a business purpose a commercial loan, I'd hate to argue the case in a "liberal" or debtor friendly court.Bill Gulley is as usual correct in his analysis; the bottom line is why take on the risk, hassle and potentially negative outcome.
